||It was brought to the Board's attention that Tussey’s had entered into a consent agreement and voluntarily surrendered his license in the State of Ohio on May 26, 2021, in that he failed to cooperate after being selected for a continuing education audit. Tussey failed to report this disciplinary action against his Ohio license in violation of W. Va. Code R. §16-1.8.8 requiring a licensee to report such discipline to the Board within 30 days of that discipline. During the Board's investigation of this matter, it was revealed that Tussey failed to complete the necessary 24 hours of Board-approved continuing education within the applicable two-year licensing period in violation of W. Va. Code R. §16-1-11.2. Documentation submitted by Tussey revealed that he fell 18.5 hours short of the 24 hours needed to remain active and in good standing.
||Tussey shall, at his own expense, make up 18.5 hours of Board-approved continuing education for the 2019-2020 reporting period. Tussey shall submit written proof of completion of these hours to the Board. These makeup hours are in addition to what is otherwise required in order to maintain licensure as a physical therapist assistant during the current reporting period and these make-up hours shall be completed within 60 days of the entry of the consent agreement and order.
Tussey shall also, at his own expense, enroll in and successfully complete six hours of Board-approved course(s) in ethics. This shall be completed within 60 days of the Order.
Tussey shall be subject to a mandatory audit of his continuing education hours prior to the next renewal
of his license.
Tussey shall pay a continuing education non-compliance fee in the amount of $200 within 60 days of entry of the Order.
