||Michael Dempsey, PTA
||W. Va. Code §30-20-14, W. Va. Code §30-20-19(g)(4) and W. Va. Code R. §16-1
||Dempsey renewed his license by December 31, 2019, as required by applicable statute and regulation. On that renewal application he attested that he completed 24 hours of board approved continuing education within the 2018-2019 reporting period. Dempsey was selected for a continuing education audit. Dempsey failed to respond to the audit letter. On March 18, 2020, the board initiated a complaint against Dempsey for failing to respond to the mandatory audit of his continuing education hours. Dempsey did respond to the board-initiated complaint and submitted to the board documentation of his continuing education hours for the applicable reporting period. Documentation revealed that 11.25 hours were not board approved. Thus, Dempsey did not complete his continuing education requirements for the 2018-2019 reporting period.
||Dempsey shall at his own expense, make up the 11.25 hours of Board-approved continuing education for the 2018-2019 reporting period. These hours are in addition to what is otherwise required in order to maintain licensure as a physical therapist assistant and shall be completed within 60 days.
At his own expense, Dempsey must enroll in and successfully complete six (6) hours of online Board approved course(s) in Ethics. These are in addition to what is otherwise required to maintain licensure.
He shall be subject to a mandatory audit of his continuing education hours prior to the next renewal of his license. He shall also pay a continuing education non-compliance fee in the amount of $200.
