Violated Law: W. Va. Code §30-20-14(c); W. Va. Code §30-20-19(g)(1); W. Va. Code R. §16-1
Violation: ON DECEMBER 15, 2017, MR. GANSER COMPLETED A RENEWAL APPLICATION FOR HIS PTA LICENSE. ON THIS APPLICATION, MR. GANSER CHECKED THE BOX WHICH READ, "I HAVE FULFILLED THE CE REQUIRMENT." THE BOTTOM OF THIS APPLICATION REQUIRES THE APPLICANT TO SIGN AFTER THE STATEMENT, "I CERTIFY THE INFORMATION REPORTED ON THIS FORM IS TRUE AND CORRECT." MR. GANSER SIGNED AFTER THIS STATEMENT. MR. GANSER WAS REQUIRED TO COMPLETE A PAPER APPLICATION BECAUSE OF A DUI MISDEMEANOR CONVICTION HE RECEIVED IN 2015. IN FEBRUARY 2018, THE BOARD CONDUCTED A RANDOM AUDIT OF ITS LICENSEES' CONTINUING EDUCATION. MR. GANSER'S NAME WAS SELECTED AND ON FEBRUARY 15, 2018, THE BOARD SENT MR. GANSER A CERTIFIED LETTER NOTIFYING HIM THAT HE HAD BEEN SELECTED FOR THE ANNUAL AUDIT REVIEW FOR CALENDAR YEARS 2016-2017. ON FEBRUARY 26, 2018, MR. GANSER SIGNED FOR THIS CERTIFIED LETTER MAILED TO HIS LAST KNOWN ADDRESS. ON MARCH 27, 2018, THE BOARD EMAILED MR. GANSER A REMINDER THAT IT HAD NOT RECEIVED A RESPONSE TO THE CONTINUING EDUCATION AUDIT. MR. GANSER NEVER SUBMITTED THE REQUIRED INFORMATION. THE BOARD THEN NOTIFIED MR. GANSER BY CERTIFIED LETTER THAT IT WAS PROCEEDING WITH DISCIPLINARY ACTION AGAINST HIS LICENSE FOR HIS "FAILURE TO CONFIRM THAT HE HAD COMPLETED 24 HOURS OF BOARD APPROVED CONTINUING EDUCATION WITHIN THE APPLICABLE TWO-YEAR LICENSING PERIOD AND FOR POSSIBLY MISREPRESENTING HE HAD COMPLETED SUCH HOURS WHEN HE SUBMITTED HIS RENEWAL APPLICATION. A PROPOSED CONSENT AGREEMENT WAS OFFERED AND MR. GANSER SIGNED FOR THIS LETTER AND CONSENT AGREEMENT BUT DID NOT CONTACT THE BOARD OR BOARD ATTORNEY. THE BOARD THEN SENT MR. GANSER THE STATEMENT OF CHARGES AND NOTICE OF HEARING BY BOTH CERTIFIED AND REGULAR MAIL TO THE ADDRESS ON RECORD. MR. GANSER DID NOT APPEAR AT THE HEARING, REQUEST A CONTINUANCE, OR RESPOND TO THE BOARD IN ANY WAY.
Penalty: BASED ON THESE FINDINGS OF FACT, THE BOARD HAS ORDERED MR. GANSER'S LICENSE TO BE SUSPENDED FOR THE REMAINDER OF THE LICENSING PERIOD, WHICH ENDS DECEMBER 31, 2019. IT IS ALSO ORDERED THAT MR. GANSER REIMBURSE THE BOARD FOR ADMINISTRATIVE COST IN THE INVESTIGATION TOTALING $1,185.78 PAYABLE WITHIN 60 DAYS. MR. GANSER MAY SEEK REINSTATEMENT AFTER THE SUSPENSION PERIOD AND AFTER HE REIMBURSES THE BOARD FOR ADMINISTRATIVE COSTS. MR. GANSER WILL BE SUBJECT TO A MANDATORY AUDIT OF CONTINUING EDUCATION HOURS AS PART OF THE RENEWAL OR REINSTATEMENT PROCESS. IF THE BOARD DO NOT APPROVE MR. GANSER'S REINSTATEMENT APPLICATION, HE MAY REQUEST A HEARING TO SEEK REINSTATEMENT.
