Violated Law: W. Va. Code §30-20-19 et seq., W. Va. Code R. §16-1-7.2, W. Va. Code R. §16
Violation: THE BOARD RECEIVED A WRITTEN COMPLAINT FROM CARE PARTNERS HOME HEALTH, CONCERNING ALLEGATIONS THAT MS. CROUSE TOOK PRESCRIPTION DRUGS FROM A HOME HEALTH PATIENT SHE WAS TREATING. MS CROUSE ADMITTED TO SUCH CONDUCT AND VOLUNATIRLY PLACED HER LICENSE ON INACTIVE STATUS WHILE THE BOARD INVESTIGATED THE MATTER. THE BOARD DETERMINED PROBABLE CAUSE BE FOUND IN VIOLATION OF THE BOARDS RULES AND REGULATIONS.
Penalty: MS. CROUSE'S LICENSE SHALL BE SUSPENDED FOR A PERIOD OF ONE YEAR. MS. CROUSE SHALL NOT ENGAGE IN THE PRACTICE OF PHYSICAL THERAPY, EITHER DIRECTLY OR INDIRECTLY, IN THE STATE OF WEST VIRGINIA, DURING SUCH PERIOD OF SUSPENSION. WITHIN 30 DAYS FROM THE ENTRY OF THE CONSENT AGREEMENT AND ORDER, MS. CROUSE SHALL UNDERGO PHYSCHOTHERAPY OR COUNSELING, AT HER OWN EXPENSE, TO ADDRESS HER ETHICAL VIOLATIONS AND SUBSTANCE ABUSE. AFTER SIX MONTHS, MS. CROUSE SHALL AUTHORIZE THE TREATING PSYCHOLOGIST OR COUNSELOR TO SUBMIT A REPORT OF PROCESS TO THE BOARD. MS. CROUSE SHALL NOTIFY THE BOARD IN WRITING IF SHE SEEKS TO HAVE HER LICENSE REINSTATED AT THE END OF THE ONE YEAR SUSPENSION PERIOD. THIS WRITTEN NOTIFICATION MUST BE SUBMITTED TO THE BOARD NO LATER THAN 60 DAYS PRIOR TO THE EXPIRATION OF THE SUSPENSION PERIOD. A FITNESS FOR DUTY EVALUATION MAY BE REQUIRED FOR REINSTATEMENT. IF REINSTATEMENT IS APPROVED, MS. CROUSE'S LICENSE SHALL BE PLACED ON PROBATION FOR A PERIOD OF ONE YEAR. DURING THIS PROBATION PERIOD, MS. CROUSE IS PROHIBITED FROM PROVIDING IN-HOME HEALTH CARE AND SHALL PRACTICE PHYSICAL THERAPY ONLY UNDER THE DIRECT SUPERVISION OF A LICENSED PHYSICAL THERAPIST, WHO SHALL COSIGN ALL EVALUATIVE AND TREATMENT WORK COMPLETED BY MS. CROUSE. THE SUPERVISING PHYSICAL THERAPIST SHALL SUBMIT QUARTERLY REPORTS TO THE BOARD REGARDING MS. CROUSE'S PERFORMANCE. BY THE 1ST DAY OF THE 11TH MONTH OF THE PROBATION PERIOD, THE SUPERVISING LICENSED PHYSICAL THERAPIST SHALL SUBMIT A FINAL REPORT TO THE BOARD, WHICH SHALL INCLUDE A RECOMMENDATION CONCERNING MS. CROUSE'S ABILITY TO RETURN TO INDEPENDENT PRACTICE. DURING THE 12TH MONTH OF THE PROBABTION PERIOD, MS. CROUSE SHALL APPEAR BEFORE THE BOARD TO DOCUMENT AND ASSURE THE BOARD THAT SHE HAS MET ALL REQUIREMENTS OF THE CONSENT AGREEMENT AND ORDER AND AFFIRM SHE IS READY AND ABLE TO RETURN TO INDEPENDENT PRACTICE.
