Disciplinary Date: 08/07/18
PT/PTA Name: Charles F. Dodson, PT
Violated Law: W. Va. Code R. § 30-20-19(g) et seq.
Violation: The Board has found that Mr. Dodson engaged in conduct or behavior that violates W. Va. Code § 30-20-19(g) et. seq. in that on or about July 31, 2018 Mr. Dodson pleaded guilty to attempt to commit a felony and was previously indicted on charges including but not limited to sexual abuse by a parent, guardian, custodian or person in position of trust to a child. Mr. Dodson was employed by Mercer County Board of Education at the time of his arrest.

On August 29, 2018, a hearing concerning the summary suspension took place at the Board office. At the end of the hearing, the parties agreed to hold the matter in abeyance until the evaluative report was received in the underlying criminal matter. Mr. Dodson agreed to remain under summary suspension during the time of the abeyance period. Based on the findings of the evaluative report and based on the Mercer County Circuit Court Order, Docket no. 17-F-338-DS, placing Mr. Dodson on deferred adjudication for three (3) years with the anticipation that all criminal charges will be dismissed, the parties agreed that Mr. Dodson's continuation to practice does not constitute an immediate danger to the public. The parties agreed that Mr. Dodson's license should be reinstated and any outstanding disciplinary issues be resolved by entering into a consent agreement. The summary suspension was lifted and Mr. Dodson's license was reinstated on January 11, 2019.
Penalty: The Board has summarily suspended Mr. Dodson's license pursuant to W. Va Code 30-1-8(e)(1). Hearing has been set for August 29, 2018 at 9:30 a.m.

Mr. Dodson's license to practice physical therapy in the state of West Virginia is placed on probation for the duration of the 3-year deferred adjudication period.
